TERMS OF SERVICE
Effective Date: September 17, 2026
Introduction
Welcome to ASA Yoga Pilates. These Terms of Service (“Terms”) govern your use of the ASA Yoga Pilates website, scheduling services, classes, appointments, memberships, packages, and related services. ASA Yoga Pilates is operated by 28Ventures LLC, doing business as ASA Yoga Pilates (“ASA,” “we,” “us,” or “our”). By purchasing, booking, registering for, or participating in our services, you agree to these Terms and any additional policies or agreements presented to you at checkout or registration.
1. Fitness Services
ASA Yoga Pilates provides fitness and wellness services that may include reformer Pilates, mat Pilates, yoga, group fitness classes, dance and movement classes, stretching and mobility classes, private sessions, semi-private sessions, sound bath and wellness-oriented classes, and other fitness or wellness services offered by the studio. Services, instructors, schedules, class formats, and availability may change.
2. Not Medical Care
ASA Yoga Pilates does not provide medical diagnosis, treatment, physical therapy, or medical advice.
Nothing provided by ASA Yoga Pilates, its instructors, employees, contractors, website, or marketing materials should be interpreted as medical advice. You should consult an appropriate healthcare professional before beginning a new exercise program when appropriate for your circumstances.
3. Assumption of Fitness Risks
Physical exercise involves inherent risks. Participation in Pilates, yoga, stretching, dance, reformer exercise, strength training, and other physical activities may involve risks including falls, strains, sprains, muscle soreness, equipment-related injuries, aggravation of preexisting conditions, and other injuries. Participants are responsible for exercising within their personal abilities and informing the instructor of relevant physical limitations before participating. A separate participation waiver and release may be required before attending classes.
4. Bookings
Classes and appointments are subject to availability. A reservation is not guaranteed until it has been uccessfully booked through an authorized ASA Yoga Pilates booking method. Private and semi-private appointments should be booked through ASA Yoga Pilates's authorized scheduling system, website, front desk, or management. ASA Yoga Pilates may modify instructors, substitute instructors, reschedule sessions, or cancel classes when reasonably necessary.
5. Check-In
Members and guests must check in for each scheduled class or appointment using the studio's designated check-in procedure. Failure to properly check in may result in the reservation being treated as a no-show if ASA cannot reasonably verify attendance.
6. Cancellation Policy
Unless a different policy is clearly disclosed for a particular service, reservations must be cancelled at least 12 hours before the scheduled start time to avoid a late-cancellation charge or loss of the applicable class credit. Cancellations made inside the 12-hour cancellation window may result in loss of the applicable class/session credit and/or a late-cancellation fee where disclosed and permitted. Failure to attend a reservation without cancelling may be considered a no-show and may result in loss of the session credit and/or an applicable no-show fee. Specific membership plans or promotional packages may contain additional cancellation terms disclosed at purchase.
7. Minimum Group Class Enrollment
Group classes generally require a minimum of three participants. ASA Yoga Pilates reserves the right to cancel or reschedule a group class that does not meet minimum enrollment requirements. If ASA cancels a class because minimum enrollment is not met, the customer's applicable class credit will be restored or the customer will otherwise receive the remedy stated for that purchase.
8. Pricing
Prices are displayed at the time of purchase and may change prospectively. Price changes will not retroactively change completed purchases except where expressly permitted by the applicable agreement or required by law. Promotional prices, discount codes, introductory offers, student discounts, flash sales, and other promotions may have separate eligibility requirements and expiration dates. Promotional offers may not be combined unless expressly stated.
9. Class Packages and Credits
Class packs and session packages are subject to the terms displayed when purchased. Any expiration period will be clearly disclosed when applicable. Unused sessions generally have no cash value except where otherwise required by California law. Packages may not be transferred or resold without ASA Yoga Pilates's written approval.
10. Memberships
Membership benefits, billing frequency, commitment periods, included services, and cancellation requirements will be disclosed when the membership is purchased. If a membership automatically renews, the automatic-renewal terms will be disclosed before purchase and ASA Yoga Pilates will obtain the consent required by applicable law. Customers will be provided legally required methods to cancel recurring memberships. When a membership is purchased online, ASA Yoga Pilates will provide an online cancellation method as required by applicable California law. Nothing in these Terms eliminates cancellation, refund, relocation, disability, or other rights that cannot legally be waived under applicable California law.
11. Annual Memberships
Annual memberships are subject to the specific agreement presented at purchase. Any automatic renewal will be separately and clearly disclosed. If an annual membership automatically renews, legally required renewal notices and cancellation options will be provided.
12. Refunds
Except where otherwise stated at purchase or required by law, completed classes and services are nonrefundable. Refund eligibility for unused packages, memberships, annual agreements, prepaid services, or other purchases is determined by the applicable purchase agreement and California law.
ASA Yoga Pilates does not waive any consumer cancellation or refund rights that are required by law.
13. Payment Authorization
By providing a payment method, you authorize ASA Yoga Pilates and its payment processors to charge amounts you expressly agree to pay. Recurring charges will only be made pursuant to an applicable recurring-payment authorization. Customers are responsible for maintaining accurate billing information.
14. Chargebacks and Payment Disputes
If you believe a charge was made incorrectly, please contact ASA Yoga Pilates promptly so we can investigate. Nothing in these Terms prevents you from exercising any dispute rights available through your financial institution or applicable law.
15. Studio Conduct
Customers are expected to treat instructors, employees, contractors, and other members respectfully.
ASA Yoga Pilates may refuse service or terminate participation for conduct involving threats, harassment, discrimination, violence, intentional property damage, theft, dangerous behavior, or substantial disruption of studio operations, subject to applicable law.
16. Equipment
Studio equipment may only be used as instructed. Participants should not adjust, move, operate, or use equipment in a manner contrary to instructor directions or studio rules. Participants should immediately report damaged or malfunctioning equipment.
17. Personal Property
Customers are responsible for their personal belongings while visiting the studio. To the fullest extent permitted by law, ASA Yoga Pilates is not responsible for lost, stolen, misplaced, or damaged personal property except to the extent liability cannot lawfully be excluded.
18. Photography and Content
ASA Yoga Pilates will not treat acceptance of these general Terms as blanket consent to use a customer's recognizable image for advertising. Where we wish to use identifiable photographs or video of a customer for promotional purposes, appropriate permission may be requested separately.
Customers should respect the privacy of other members when taking photographs or videos inside the studio.
19. Intellectual Property
The ASA Yoga Pilates name, branding, website content, graphics, photographs, class materials, and other original materials are owned by or licensed to ASA Yoga Pilates unless otherwise stated. They may not be copied, sold, reproduced, or commercially exploited without authorization.
20. Website Availability
We attempt to maintain accurate website and scheduling information but cannot guarantee that the website or booking platform will always operate without interruption. Obvious technical, scheduling, or pricing errors may be corrected.
21. Third-Party Services
Our website or scheduling process may integrate services operated by third parties. Use of those services may also be governed by the third party's own terms and privacy policies.
22. Limitation of Liability
To the fullest extent permitted by applicable law, ASA Yoga Pilates and 28Ventures LLC will not be liable for indirect, incidental, special, or consequential damages arising solely from use of the website. Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under California law. Any separate assumption-of-risk or release agreement signed by a participant will be governed by its own terms and applicable law.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Nothing in these Terms eliminates any rights or remedies that cannot legally be waived.
